Russians can't always go on vacation in the summer, even if they want to. The employer has the right to refuse to postpone the annual paid leave for the summer months if the rest dates are already fixed in the approved vacation schedule. Irina Shulzhenko, Director of the Roskachestvo Organizational Development Department, told Izvestia about this on July 4.

"The order of vacation provision is determined by the vacation schedule, which is approved by the employer no later than two weeks before the beginning of the calendar year. If an employee's vacation is already scheduled for another time, the employer has the right not to agree on its postponement for the summer months. The Labor Code guarantees annual paid leave, and specific dates are determined by agreement of the parties and fixed in the vacation schedule," she explained.

At the same time, the expert recalled that the law provides for exceptions for a number of employees. Minor employees, parents of disabled children, parents with many children raising three or more children under the age of 18 (if the youngest child is under the age of 14), women before or immediately after maternity leave, as well as honorary donors of Russia have the right to choose a convenient time for annual paid leave. In these cases, the employer must take into account the wishes of the employees.

Shulzhenko also noted that employers cannot introduce internal rules that completely prohibit vacations in certain months. Such restrictions will contradict the requirements of labor legislation and infringe on the rights of employees. At the same time, when drawing up a vacation schedule, the company has the right to take into account the production necessity in order to ensure uninterrupted operation.

The expert stressed that most controversial situations can be avoided even at the stage of forming a vacation schedule. According to her, preliminary discussion with employees of plans for the next year, seasonal workload and personal circumstances helps to find a compromise, maintain the stability of work processes and give employees the opportunity to plan their holidays in advance.

On July 1, a group of deputies drafted a bill on the priority right of single parents of children under 14 to take paid leave at any time convenient for them. It is proposed to amend the Labor Code of the Russian Federation. The authors of the project noted that single parents and sole breadwinners face additional difficulties in organizing child care and combining family responsibilities with work. Besides, according to them, the current legislation does not provide special guarantees for these persons.
