A resident of Moscow, who underwent unsuccessful cosmetic surgery in a private clinic, went to court, demanding compensation from a plastic surgeon. Earlier, Izvestia reported serious complications in this patient as a result of contacting one of the capital's cosmetology centers: after the procedures, she cannot turn her head. As the newspaper found out, investigators have now opened a criminal case on illegal medical activity, but so far against an unidentified person. How was the unsuccessful operation performed?

Moscow resident Evgenia Shomova, whose health deteriorated significantly after a cosmetic procedure at the Mir Hardware Cosmetology Clinic (IAC) in September 2025, appealed to the court. According to the lawsuit reviewed by Izvestia, she is trying to hold Daria Naumenkova, a plastic surgeon at this organization, accountable. The publication has previously reported on several such complaints.

Evgenia Shomova told Izvestia that she had liposuction of the lower third of her face and neck, and also Bichat lumps were removed — accumulations of fatty tissue in the cheeks. After the procedures, the patient developed scars and neck mobility was impaired.

"When I was scared, I immediately turned to Daria," recalls Evgenia Shomova. — She said that I was holding my head in the wrong position, so everything went awry.

Now a woman can't tilt her head back and can't feel her chin.

"I was not warned about any possible consequences, risks or complications," said the Muscovite. — On the contrary, Daria promised that in two weeks I would be a "doll", and the proof of this is her number of subscribers and before/after photos on social networks.

On June 10, the Koptevsky District Court of Moscow will begin considering Evgenia Shomova's civil lawsuit demanding compensation for damage caused "as a result of injury to health." The woman sent appeals to the prosecutor's office, Roszdravnadzor, Rospotrebnadzor, the police, as well as to the territorial Investigative Committee.

The victim claims that Daria Naumenkova performed surgical and cosmetic procedures without medical education. The doctor, according to the patient, did not take any medical tests from her, but performed the operation on a massage couch. Evgenia Shomova paid 170 thousand rubles for both procedures.

"Daria Naumenkova did not provide a contract for the provision of services, and payment receipts were not issued, as all payments were made bypassing the cash register," the statement of claim says.

And Evgenia Shomova told Izvestia that she wanted to "show the fairness of justice."

"So that girls won't be afraid to punish such butchers and defend their rights," she said.

Initiation of a case

In February 2026, at the request of Evgenia Shomova, a criminal case was opened under the article on carrying out medical activities without a license, which caused harm to health. So far, there are no defendants in it.

"On September 6, 2025, an unidentified person, while in the clinic of Mir Hardware Cosmetology LLC [...], performed a medical cosmetology procedure — liporeduction of Evgenia Shomova's chin and neck, which caused harm to her health," follows from the resolution of the Nagatinsky Interdistrict Investigative Department of the Investigative Department for the Southern Administrative District of Moscow.

But after the case was initiated, Evgenia Shomova filed a complaint with the district department of the Interior Ministry and the prosecutor's office.

— The case was initiated against an unknown person, although everything is known. Her (Naumenkova. They're already on TV," the victim complained. — I told the investigator that she cut me, I have proof.

Earlier, another patient of the Mir Hardware Cosmetology clinic told Izvestia on condition of anonymity that she had suffered at the hands of Daria Naumenkova. The woman signed up for botox and liposuction, but the doctor convinced her to inject a filler into her nose.

"I had severe swelling of my eyes and face, and my eyesight dropped significantly," she complained. — Before the procedures, the specialist did not take any tests from me. This alerted me for a moment, but it was too late, the doctor began her manipulations.

According to the woman, there are other victims, but they are not ready to contact the police.

Izvestia was unable to contact Daria Naumenkova, but the surgeon had previously confirmed to the publication that she had received complaints from a client. According to her, these were "not only claims, but also threats."

"I wrote a statement to the police about extortion," said Daria Naumenkova. — She (the victim. She did the procedure for me, and a few days later she started extorting 1 million rubles, threatening to damage her reputation and harass me on social networks. I do not plan to respond to the actions of this person, I have passed all the information to law enforcement agencies."

Judging by information on Daria Naumenkova's social networks, you can still make an appointment with her online. She offers clients a wide range of services — liposuction of the chin and hands, blepharoplasty (correction of the shape of the eyelids), neck lift and even plastic surgery of the auricles. The cost of one procedure is from 25 thousand to 250 thousand rubles.

Is it realistic to receive compensation

Criminal cases against specialists who performed a cosmetic procedure poorly are initiated in the presence of serious consequences, Anton Pivovarov, a lawyer at the Moscow Sed Lex Bar Association, told Izvestia.

— As a rule, this happens if the patient's health is harmed or there was a threat to his life, — he noted. — Article 238 of the Criminal Code of the Russian Federation ("Provision of services that do not meet safety requirements") is most often used, less often — 235 of the Criminal Code of the Russian Federation ("Illegal medical activity"). There are cases when a guilty verdict is passed, but the case may be terminated due to lack of evidence of a causal relationship between the actions of the doctor and the health consequences.

The lawyer clarified that the key factor in such a situation is the conclusion of a medical examination.

"If the experts conclude that the doctor's actions did not comply with the protocols and led to undesirable consequences, the court is likely to side with the plaintiff," says Anton Klyuchko, head of the law branch of Klyuchko, Landau and Partners.

Anton Pivovarov believes that the injured client has a real chance of compensation for moral damage and medical expenses in a civil procedure.

— To do this, it is necessary to confirm the fact of the provision of the service, the existence of harm to health and the causal relationship between the procedure and the consequences, - he said.

An "unidentified person" appears in the criminal case, since the investigation is collecting evidence and is not yet physically ready to charge Daria Naumenkova, Anton Klyuchko suggested.

"Even if there are videos, Naumenkova is not deprived of the right and opportunity to deny her involvement,— the lawyer explained. — Then it will be necessary to carry out separate checks, for example, a photographic examination, which will determine whether she is depicted on the video.

According to the expert, if the involvement of the plastic surgeon is proven, she faces up to three years in prison for illegal medical activity.

Anton Klyuchko believes that there is currently no proper control over the beauty services market in Russia.

"The number of such cases is increasing, and it's not uncommon now," the lawyer admitted. — You should beware of undergoing surgical procedures in coworking spaces. In addition, cosmetology, and even more so surgery, requires licensing. The only exception is "household cosmetology". Therefore, it is necessary to check in advance the licenses and diplomas of the specialists you are going to apply to.

In the lawsuit, Evgenia Shomova estimated the moral damage at 1 million rubles. She also demanded to recover from the defendant 170 thousand rubles paid for the operation, lawyer's expenses in the amount of 150 thousand rubles, as well as another 428 thousand rubles. penalties are for unfulfilled requirements previously imposed on the surgeon.

Izvestia reviewed the judicial practice on similar claims. So, in the Krasnodar Territory, for unsuccessful blepharoplasty and facelift, the court estimated the amount of moral damage to the injured woman at 3 million rubles, and to her husband at 500 thousand. And in the Rostov region, in the spring of this year, a patient who had facial paralysis after surgery was awarded 1.5 million rubles.
