Russians will be able to receive a CTP payment without taking into account depreciation. This will be a new compensation option that will allow car owners to expect a larger amount. Now insurance companies take into account car wear and tear, and for old cars, compensation in money may be less than is actually required to restore the car. Now a person will be able to receive the first payment, apply for repairs at their car service, and if there is not enough money, the insurance company, according to the new rules, will compensate for the difference. Such a bill is being prepared for submission to the State Duma (Izvestia has it). As a result, the payment will even cover hidden damages, the Russian Union of Motor Insurers clarified. How is car wear and tear taken into account when monetary compensation is provided for CTP

The authorities plan to introduce a new option for CTP reimbursement. It will allow Russians to repair cars at any service station, as well as receive the full amount from the insurer for self-repair of cars.

It is assumed that both forms of compensation, which are still in force, will remain in the law. First, the insurer will be able to send the car for repair to the service station with which it has a contract, and independently organize the restoration of the car. Secondly— the company can pay monetary compensation to the victim. This amount will take into account the wear and tear of the car, as it still applies now: that is, the older the car, the less money the customer will receive. At the same time, the maximum percentage of wear is 50%.

And in the proposed new version, Russians will also have the right to apply for an additional payment if the first one was not enough for repairs. The victim will be able to go to any car repair shop of his choice, and then send the insurer a confirmation that the restoration of the car cost more than the amount he initially received. You will need to send the documents about the repair payment and show the repaired car.

After that, the insurer will be required to pay the customer the difference between the actual costs and the initial compensation, namely the cost of depreciation, which was deducted earlier. Such a bill is currently being prepared for submission to the State Duma, Izvestia has it. The document has been agreed with the Central Bank, a source familiar with the discussion told the editorial board. The Bank of Russia itself does not have the right to legislative initiative.

Under the new scheme, the victim will actually be able to receive an additional payment for wear and tear, the amount of which is deducted from the initial compensation, and for hidden damages if any are found during the repair process, Evgeny Ufimtsev, head of the Russian Union of Motor Insurers (RSA), explained to Izvestia. According to him, due to this, the amount of compensation for customers will increase. The recalculation will be carried out according to the unified methodology of the Central Bank.

At the same time, a person will still have the right to receive payment under the contract in money and not to make repairs if the damage is insignificant and does not interfere with the use of the car or he simply does not want to repair the car, Evgeny Ufimtsev added. In this case, there will be no additional payment under the new scheme.

The document also discusses several additional requirements for a new form of compensation. If the customer requests an additional payment, he will be obliged to bring the repaired car for inspection within five days after the insurance claim. The company will have to send the money in 20 calendar days.

In addition, if the service detects hidden damage, the customer will be obliged to inform the insurance company about it while repairs are underway. The insurers will be supervised by the Bank of Russia.

Is it possible to get more money for repairs on insurance

This initiative is designed to eliminate two serious problems in the CTP segment, according to Alexey Bredikhin, director of the ACRA Financial Institution Ratings group. First, the payment in cash will allow insurers to settle losses in 30 days, as required by law. Carrying out repairs during this period is now almost impossible due to insufficient inventory of spare parts and the lengthening of their delivery dates to Russia against the background of sanctions.

On the other hand, cash payments — and it is this option that is currently used in most cases — are often not enough for people to fully cover repair costs, which contradicts the spirit of the CTP law and causes customer dissatisfaction, the expert emphasized. This is a significant problem, agreed Irina Frank, CEO of Frank Auto. According to her, wear and tear often consumes 20-50% of the payout, depending on the age of the car. For cars older than seven years, the amount of compensation can be only half, which makes repairs without additional charges almost impossible.

According to Irina Frank, compensation for cars older than five years can increase by 30-40%, which is equivalent to tens of thousands of rubles. The option will be in demand, as car owners will have more control over repairs and increase the chances of a full refund, the expert is sure.

Insurers supported the legislative initiative. The changes will expand the client's ability to contact any service station, said Ivan Popov, Director of the Department of Motor Vehicle Damage Control at IC MAKS. According to him, the victim will not be tied to the availability of a contract for a particular service with an insurer. This means that a person will be able to contact the station near the house and independently choose the time and amount of repairs.

At the same time, the services are more willing to work with customers directly, avoiding contractual discounts that insurance companies often impose on partners. It will also reduce bureaucratic delays, speeding up the process, Irina Frank added.

The new option will be popular, including due to the lack of strict repair deadlines, auto expert Yulia Fedotova is sure. In addition, the option will allow you to take into account hidden damage. Upon initial inspection, it is not always possible to fully assess the damage. This can increase the satisfaction of car owners, Maxim Kolyadov, head of work with individuals at Insurance Broker AMsec24, agreed.

This innovation will help reduce tension between companies and customers in the settlement of insurance claims, according to the VSK. In their opinion, this will also increase the number of repairs.

Disadvantages of the new type of CTP compensation

In some cases, even under the new payment scheme, it may not be enough for repairs, Maxim Kolyadov warned. For example, due to the high prices for spare parts and services of a particular car service, which may exceed the average market values, the expert noted.

In addition, according to the new scheme, the insurance company does not guarantee the quality of the work performed, because of this, the victim may be dissatisfied with the result, Sovcombank Insurance noted. In addition, the client, as a rule, does not have sufficient expertise to independently assess the actual volume and cost of the required repairs.

Another danger is that the cash payment creates conditions for abuse by unscrupulous victims and their representatives who exploit gaps in legislation, Sovcombank Insurance added.

Risks exist when there are gray areas — that is, not everything is clearly and clearly spelled out in the law, said Evgeny Ufimtsev from the RSA. Therefore, according to him, the change should not be targeted, but comprehensive, so that the compensation system would work differently and disputes in the field of CTP would be eliminated.

However, there is another danger, Maxim Kolyadov believes. Insurers will have to pay more to customers with monetary compensation. This means that there is a possibility that they may increase the cost of policies to compensate for possible losses.
