The main essence of a suspended sentence is that the convicted person is not sent to a penal colony, but is under state control during the entire probation period. Vadim Bagaturia, a criminal law specialist, told Izvestia about this on June 18, commenting on the verdict against blogger Alexandra Mitroshina.
"Such a punishment means that blogger Mitroshina will have to report to the Federal Penitentiary Service every two weeks for the next three years, not commit administrative offenses or crimes. And then her probation will remain suspended," he explained.
The lawyer also clarified that with a suspended sentence, restrictions on travel outside of Russia may also apply. At the same time, movement within the country is not limited. If the court does not specifically establish a ban, the convicted person can continue to conduct professional and commercial activities, including blogging and selling online courses.
According to Bagaturia, administrative violations do not always lead to a penal colony, however, in combination and with their severity, they can become grounds for tougher punishment. So, for minor administrative matters, for example, crossing the road in the wrong place, Mitroshina will not be placed in a colony. In addition, the expert pointed out that the suspended sentence is a kind of "credit of trust" on the part of the court.
Earlier that day, Mitroshina was sentenced to three years of probation and fined 900 thousand rubles. She was found guilty of laundering 127 million rubles. Mitroshina's real estate worth a total of 115 million rubles will be confiscated into state ownership. At the same time, the blogger herself said after the verdict that she would continue to engage in a personal blog.
