A new trend in social media
A new trend has spread on the TikTok social network, in which schoolchildren post videos with the participation of teachers. So, users mount videos with photos of teachers and superimpose audio on them with a list of characters from the TV series "Very Strange Things" with the addition of obscene vocabulary.
It is noted that in such videos, "positive" teachers are referred to by the names of the characters without distortion, while "negative" teachers are accompanied by obscene inserts.
Responsibility for the insult
Lawyer Ilya Rusyaev, in a conversation with Izvestia, stated that insulting a teacher can entail both administrative and civil liability, including compensation for moral damage.
"The basic norm for such conflicts is Article 5.61 of the Administrative Code of the Russian Federation on insults," he said.
According to the expert, we are talking about the humiliation of honor and dignity in an indecent manner. At the same time, there is no separate article for insulting a teacher, but the law on education obliges students to respect school staff. The lawyer stressed that the degree of responsibility depends on the circumstances. Stricter sanctions are applied if the insult is of a public nature, for example, posted on the Internet or spoken in front of a group of people.
The expert noted that administrative and criminal liability begins at the age of 16. Up to this age, a teenager is not held administratively liable, but damages can be recovered from the parents. According to him, the amount of compensation for moral damage is determined by the court individually and depends on the nature of the statements and their consequences.
"When signs of incitement to hatred based on national, religious or other protected grounds appear in the words of a teenager, the case falls within the scope of Article 20.3.1 of the Administrative Code of the Russian Federation, and in aggravating circumstances, Article 282 of the Criminal Code of the Russian Federation," he said.
Responsibilities of parents
According to Alexei Zhuravlev, deputy of the State Duma, First Deputy Chairman of the Defense Committee, the family is a key link in fostering respect for the teacher. In a conversation with Izvestia, he noted that the long-term perception of learning as a service has reduced the authority of the teacher, and children are adopting aggressive behaviors from the family and the Internet. The deputy stressed that an integrated approach is needed to solve the situation, including raising the status of a teacher at the legislative level and returning the educational role of the school.
He also said that amendments on the introduction of special administrative responsibility for insulting teachers in the performance of their duties are currently being worked out. Among the measures discussed are heavy fines for parents and the return of grades for behavior to schools.
Fighting bullying
At the same time, Alexander Tolmachev, Deputy chairman of the State Duma Committee on Youth Policy, emphasizes that the law "On Education" already enshrines the special status of teaching staff. According to him, the Committee on youth policy is developing a document on countering bullying and bullying, which should protect not only children, but also teachers.
"It's no secret that children build their attitudes towards the world around them and other people based on their parents' view of things. Therefore, it is not surprising that if a child hears disrespectful comments about other elders from his parents, then he will treat them the same way. Children often adopt the behavior and attitude of their parents," he said.
