The lawyer warned about the risks of AI errors in the absence of clear regulation
Artificial intelligence (AI) is increasingly being used in everyday life and already affects social and legal relations, but its mistakes remain poorly regulated. Lawyer Alexander Barkanov told Izvestia about this on April 17, noting that the current legislation does not fully take into account the specifics of such technologies.
According to the expert, artificial intelligence is involved in public relations, often unnoticed by users. At the same time, data processing algorithms do not exclude errors, especially in the humanitarian field. The specialist explained that texts created by neural networks can often be recognized by their characteristic features — formulaic formulations, clerical style and lack of personalization.
"In Russia, AI regulation is in the formative stages. There is no comprehensive legislation yet, and disputes about compensation for harm are considered on the basis of general norms of civil law and the law on consumer protection, which do not always take into account the specifics of such relations," Barkanov said.
According to him, bringing to justice is complicated by the need to identify the perpetrators, prove the error and take into account the transnational nature of technology.
Barkanov added that the Russian Ministry of Finance has submitted for discussion a draft law "On the basics of state regulation of the application of artificial intelligence technologies in the Russian Federation." The document is expected to enter into force in September 2027. It defines artificial intelligence as "a set of technological solutions that mimic human cognitive functions." He explained that the key here is precisely the concept of "imitation".
"With this in mind, users should be more attentive to situations related to the use of AI, including the terms of transactions and the provision of services. All cases of the obvious presence of the automated data processing factor require increased attention," Barkanov concluded.
On March 22, Deputy Speaker of the State Duma Boris Chernyshov (LDPR) proposed the creation of an institute for the protection of citizens' rights in cooperation with AI technologies. According to him, the new body will be able to receive complaints about decisions related to artificial intelligence, analyze algorithm errors and cases of fake news. The Institute's tasks also include preparing recommendations for the safe implementation of AI in business and government structures.
