The expert spoke about the nuances of taking a study leave.
The right to study leave is granted to employees who combine work with study at accredited educational institutions, but its payment depends on the form of study. Irina Shulzhenko, Deputy Director of the Roskachestvo Organizational Development Department, told Izvestia about this on February 13.
According to the expert, employees who simultaneously work and study at accredited colleges and universities have the right to study leave. It depends on the form of study (correspondence, part-time or full-time) whether the vacation will be paid or not, Shulzhenko explained.
"When studying full-time, study leave is not paid, and if you study full-time or part-time, then the average salary remains for the employee for the period of study leave. An important condition is that education must be obtained for the first time at this level, for example, if this is the first bachelor's degree or a master's degree after the bachelor's degree. But the second higher education of the same level no longer guarantees paid leave, and the employer can legally refuse," the expert explained.
As Shulzhenko noted, the specific terms of study leave range on average from 30 to 50 calendar days per year per session, up to 30 days for state exams and up to four months for the preparation and defense of graduation work. At the same time, if the vacation is paid, then the employee retains the average earnings, she added.
"To apply for a study leave, you only need two documents: a call-out certificate from an educational institution and an application addressed to the employer. The certificate officially confirms that you are indeed admitted to the session or final assessment. The law does not set exact deadlines for submitting documents for study leave, but the sooner the employer finds out about your absence, the better it will be possible to build a team in your absence," Irina Shulzhenko noted.
If all the conditions are met and the documents are drawn up correctly, the employer cannot refuse a study leave. The specialist stressed that production necessity, deadlines, lack of people and similar arguments have no legal force, and postponement is possible only by agreement of the parties and solely with the consent of the employee.
On February 10, Minister of Labor and Social Protection Anton Kotyakov spoke about a federal program designed to help graduates of schools and universities find a job in their specialty. Then he said that in 2025, the program was launched in 11 pilot regions, where high school students, colleges and universities were directly introduced to enterprises, mentors, working conditions and salaries through recruitment centers.
