Lawyer Lyapunova told how to get rid of someone else's loan

There are still situations in Russia when a person is mistakenly recognized as a debtor because of his full namesake. Anastasia Lyapunova, lawyer and Head of Bankruptcy and Corporate Disputes Practice at Lyapunov Terekhin & Partners, spoke on November 12 about how to act in such cases.

According to the expert, despite the fact that since 2022, additional debtor identifiers — SNILS, INN and passport data — have been indicated in executive documents, old production facilities without this information can still lead to errors.

"If it turns out that someone else's debt was mistakenly "pinned" on you, act without delay," Lyapunova told the Prime news agency.

She explained that an application on the Public Services portal is considered for up to 17 days, and through the online reception of the FSSP - usually within two days. After the check, the bailiffs remove the restrictions and return the funds that were mistakenly debited. In case of losses incurred, a citizen has the right to claim compensation through the court.

The lawyer also recommended that you regularly check your data in the FSSP database, monitor notifications from banks and, if you suspect confusion, add yourself to the register of "doppelgangers" in advance.

Earlier in the day, it was reported that the share of mortgage refusals in Russia for the first time exceeded 60%. According to the National Bureau of Credit Histories, banks began to approve only 39% of applications due to the tightening of lending policies and restrictions of the Central Bank.
