In the absence of a prenuptial agreement, the process of dividing the property of blogger Oksana Samoilova and rapper Dzhigan (real name Denis Ustimenko) after the divorce may take a long time. Lawyer Dmitry Grigoriev shared this belief with Izvestia on October 10.

According to the lawyer, all property acquired in marriage is considered joint property of the spouses, unless otherwise provided by the marriage contract.

"This applies to apartments, cars, businesses, investments, advertising revenue, and creativity. The only exceptions here may be personal gifts, inheritances, or things that were acquired by everyone before marriage. At the same time, the songs of Dzhigan or Oksana's brand project will not be shared literally. That is, copyrights remain with their owners, but the income that was received during the marriage from these projects will be considered common," Grigoriev explained.

Discussing which of the spouses will get foreign real estate, the lawyer stressed that the process of dividing such objects can take a long time. Formally, it is regulated by the laws of the country in which this property is located, which means that the decision of the Russian court will have to be recognized in another state.

"If we talk about how the issue with children will be resolved, then the court always proceeds from their interests. Their age, the environment in which they live, their attachment to each parent, and the ability to ensure their stable upbringing will be taken into account," Grigoriev added.

At the same time, according to Russian law, children who have reached the age of ten can express their point of view on this issue, and teenagers who have reached the age of 14 can independently decide which parent they want to live with.

The lawyer added that all decisions regarding the division of property, children and alimony Samoilov and Dzhigan can decide without the participation of the court — it all depends on their ability to negotiate with each other.
