If a family with children is faced with unjustified refusals of benefits or benefits, the law provides an opportunity to challenge such decisions, lawyers told Izvestia.

77% of parents face problems when applying for benefits, according to the monitoring data of the Popular Front available to Izvestia.

Such refusals may be related to an incorrect assessment of family income, errors in calculations, incomplete provision of documents or incorrect interpretation of legislation by authorized bodies, said Vladimir Kuznetsov, Vice President of the Association of Lawyers for Registration, Liquidation, Bankruptcy and Judicial Representation.

First, you should file a written complaint with the territorial office of the institution that issued the refusal, recommended lawyer Ekaterina Kutuzova.

"In the absence of a reaction, contact a higher authority, additionally contacting the prosecutor's office or the court. Always keep copies of all documents and responses to confirm your position," she said.

The complaint must be filed in writing and contain a justification for disagreement with the decision, as well as references to the norms of law that, in the applicant's opinion, were violated, Vladimir Kuznetsov added. The time frame for filing a complaint is usually limited, so it is important to act promptly.

The next step, according to the lawyer, is to appeal to the court.

The Court will assess the legality and validity of the decision, as well as compliance with the procedure for its adoption.

"If the refusal is found to be unjustified, the court will oblige the relevant authority to eliminate the violations and provide the required benefits or benefits," said Vladimir Kuznetsov.

It is important to clearly formulate your requirements and justify them with reference to the current legislation, the experts noted. To do this, it is better to seek the help of paid lawyers or to take advantage of free legal advice provided by government or human rights organizations.

In case of an unlawful refusal to grant benefits or benefits, you can also file a complaint with the prosecutor's office, which will check the legality of the actions of the authorities and, if necessary, initiate an audit, added Zaur Lapugov, lawyer at Afonin, Bozhor and Partners LLC.
