The lawyer talked about ways to get compensation for damaged clothes in a cafe.


When faced with damage to clothing in an institution, it is important to properly record the incident and collect evidence to receive compensation. Ekaterina Kutuzova, a practicing lawyer at the Adyghe Republican Bar Association, told Izvestia on May 13 how to act in such situations to protect her rights.
The first step, according to her, should be an official appeal to the administration of the institution with the requirement to draw up an act on damage to property. It is necessary to take photos of the damaged item, record the contacts of the witnesses and save all documents confirming the cost of the clothes — merchandise and cash receipts. In difficult cases, it may be necessary for the dry cleaning specialists to conclude that it is impossible to restore the item.
The specialist clarified that the amount of compensation is determined taking into account several factors. In addition to material damage (the cost of an item or cleaning costs), you can claim compensation for moral damage. The courts take into account the nature of the damage, the circumstances of the incident, and the degree of the institution's guilt. For example, if the administration has not taken measures to prevent such situations, this may increase the amount of compensation.
The lawyer warned about the typical mistakes that victims make. Many people do not record the incident on the spot, do not keep documents about the value of the item, or delay applying for compensation. These miscalculations significantly complicate the process of collecting damages.
"Establishments are recommended to introduce standard response procedures: immediately record incidents, offer compensation on the spot, train staff to interact politely with guests, conclude liability insurance contracts, and store video recordings from cameras for an objective analysis of the situation," Kutuzova advised.
The expert noted that timely treatment, properly collected evidence and a competent approach will help achieve fair compensation, and restaurants will preserve their reputation and reduce legal risks.
Earlier, on March 20, it was reported that the average check of Russians in restaurants and cafes increased by 13%. In restaurants and bars, the average check increased by 12% over the year, to 2.1 thousand rubles, in cafes and canteens — by 11%, to 781 rubles, in fast food outlets — by 14%, to 512 rubles.
