Children who were conceived after the death of their fathers as a result of IVF may be granted a fixed survivor's pension with annual indexation. In 2025 it will be 8.8 thousand rubles. In February, the Constitutional Court ruled that it is necessary to amend the legislation so that such children were paid an insurance pension for the loss of the breadwinner, provided paternity is established.

As Izvestia was informed in the press service of the Ministry of Labor, approaches to amendments to the legislation that will allow to implement the ruling of the Constitutional Court are already being worked out. Now the appointment of survivor's pensions for such children is denied.

Sources close to the social block told Izvestia that the ministry may consider the option of assigning a social pension to such children rather than a survivor's insurance pension (as specified in the CC ruling). As it happens now in the case of children up to 18 (full-time students - up to 23) years of age who have lost one or both parents; a deceased single mother; both parents of whom are unknown.

To acquire the right to a social pension, there is no condition that they were dependent on the deceased parent, which completely solves the problem with reproductive children, explained one of the interlocutors of "Izvestiya". According to him, with this option, it will not even be necessary to change the legislation, it is enough only to adjust the law enforcement practice.

The social pension is fixed with annual indexation and is paid from the federal budget. This year it amounts to Br8.8 thousand for children who lost one parent. The insurance pension is paid from the Social Fund budget and depends on the number of points accumulated by the insured person. According to the Social Fund, last year the average size of the insurance pension for the loss of the breadwinner amounted to Br15.2 thousand.
