The expert explained the new rules for recalling employees from vacation

Starting from September 1, 2026, employers will be able to recall employees from vacation who work in harmful or dangerous working conditions, but only in case of emergency. This was announced on August 30 by Tatiana Podolskaya, an expert at the RANEPA Presidential Academy.

It is specified that previously such employees could not be recalled from annual leave. The new rules provide for the possibility of involving them in work only to prevent disasters, industrial accidents or eliminate the consequences of such accidents.

"The key innovation concerns workers engaged in jobs with harmful and/or dangerous working conditions. Starting from September 1, a recall becomes possible, however, only in strictly defined emergency circumstances," Podolskaya explained in a conversation with TASS.

The expert noted that the mere fact of an emergency situation is not enough. The employer must prove the need for the participation of a particular employee, taking into account his official duties.

At the same time, additional guarantees remain in place to protect employees, she continued. Recall from vacation is possible only with the written consent of the employee, and the working time during this period must be paid at least twice the amount.

In addition, the employee can take the unused part of the vacation at a convenient time during the current working year or transfer it and add it to the vacation for the next year.

Podolskaya stressed that the new regulations do not give employers the right to arbitrarily recall employees from vacation, but create a mechanism to attract the necessary specialists only in exceptional situations.

Evgeny Masharov, a member of the commission of the Civic Chamber of the Russian Federation for public control and handling of citizens' appeals, announced on August 27 that from September 1, 2026, the allowable amount of overtime for employees in Russia will increase from 120 to 240 hours per year. At the same time, the changes will not affect workers with the most severe and harmful working conditions (third and fourth degrees), as well as a number of categories of state and municipal employees who work part-time more than a quarter of the monthly working hours.
