The housing and communal services expert recalled the exceptions when paying for major repairs

The obligation to pay contributions for major repairs applies to almost all homeowners, but the legislation provides for a number of exceptions and benefits. Dmitry Bondar, an expert on housing and communal services, told the Prime agency about this on July 8.

"The obligation to transfer these funds is assigned to the owners of the premises," the expert said.

According to him, the widespread opinion that contributions can be omitted in the absence of a signed agreement is not true. The obligation of owners to transfer funds for major repairs is fixed in Articles 158 and 169 of the Housing Code of the Russian Federation.

The owners of apartments in buildings deemed to be in disrepair and subject to demolition or reconstruction are completely exempt from paying contributions. For homeowners in new buildings, there is a deferral in the payment of contributions, which, depending on the region, can be up to five years from the moment the house is included in the regional renovation program.

In addition, certain categories of citizens are entitled to compensation for expenses. Thus, pensioners over 70 years old are reimbursed 50% of the amount of contributions, and citizens over 80 years old — 100%. Benefits are also provided to disabled people of groups I and II, veterans of labor and other categories provided for by regional legislation.

The expert recalled that the debt on contributions for major repairs passes to the new owner when the apartment is sold. Penalties are charged for late payment, however, exemption from payment is provided for participants in a special military operation and their family members.

The Antimonopoly Service will have the right to set prices independently.

On June 2, the leader of the Fair Russia party and the head of the Duma faction, Sergei Mironov, proposed amendments to the Housing Code of the Russian Federation so that residents of apartment buildings could pay for heating solely according to individual meter readings, regardless of the decisions of general meetings of owners and authorities of the constituent entities of the Russian Federation.
