The State Duma recalled the employer's obligation to pay for medical examinations
Employers are required not only to arrange mandatory medical examinations for staff, but also to fully compensate for expenses if the employee paid for the procedure on their own. This was announced on July 4 by Alexey Kurinny, Deputy Chairman of the State Duma Committee on Health Protection (KPRF).
"Professional examinations must be paid for by the employer, this is stipulated in the Labor Code. If a person has paid for a mandatory professional examination himself, then the employer is obliged to reimburse him for his expenses. At the same time, during the medical examination, the employee retains his salary," the parliamentarian explained in an interview with RIA Novosti.
Kurinny clarified that the passage of doctors is necessary when applying for a job in a number of specialties, in the course of work, as well as for medical reasons. The requirement applies to employees of the food industry, catering, trade, transport, children's and communal institutions, as well as harmful industries.
According to the deputy, such measures are aimed at preventing occupational diseases and preventing mass infections. At the same time, the procedure must be organized correctly: as a rule, a referral from the company or the consent of the management for an independent examination is required.
"If an employee has passed a medical examination on their own initiative or outside the framework of a mandatory program for a specific specialty, then there may not be any compensation," Kurinny warned.
Alexander Yuzhalin, head of the legal practice at SuperJob, said on July 2 that an employee has the right to leave work earlier, provided that the time allotted for his lunch break has not been used, as well as if this is permitted by internal labor regulations and agreed with his superiors.
