An employee has the right to leave work earlier, provided that the time allotted to him for the lunch break has not been used, as well as if this is permitted by the rules of the internal labor regulations and agreed with his superiors. This was announced on July 2 by Alexander Yuzhalin, head of the legal practice at SuperJob.
"If the working time regime provides, for example, the opportunity for an employee to take a lunch break at a convenient time for him, theoretically the employee can postpone the break to the end of the working day, thereby reducing the working day. However, as a rule, employers set the exact time when an employee can exercise his legal right to a lunch break," the lawyer explained in an interview with RIA Novosti.
