The lawyer told about the fines for bathing in fountains

Bathing in a fountain may entail administrative liability if it is accompanied by a violation of public order, damage to property, or failure to comply with police requirements. Emil Khalimov, a lawyer and co-owner of the Lapino Fitness country club, told Izvestia about this on June 11.

According to him, there is no separate article at the federal level specifically for bathing in the fountain. However, in such cases, Article 20.1 of the Administrative Code of the Russian Federation on minor hooliganism may apply if a person's behavior is accompanied by obscenities, harassment of citizens or damage to property.

"The desire to cool off after jogging in the heat is physiologically understandable, but legally the fountain remains a decorative structure, not a recreation area," Khalimov said.

The lawyer clarified that according to the first part of the article on minor hooliganism, the fine ranges from 500 to 1 thousand rubles, and administrative arrest for up to 15 days is also possible. If a person refuses to comply with a police officer's lawful request to get out of the water, the fine may increase to 2.5 thousand rubles, and the likelihood of arrest increases.

In addition, the regions may have their own landscaping rules, which explicitly state a ban on bathing in fountains. In such cases, the fine is usually about 1 thousand rubles.

If a person damages the lighting, pump, nozzles or other elements of the fountain while bathing, they will have to compensate the owner of the facility. In case of significant damage, the situation may go beyond the scope of administrative responsibility and be considered already under the article on intentional damage to property.

"Intoxication is not an automatic substitution of a fine for arrest, but it is an independent composition under article 20.21, and together with disobedience, the court orders arrest more readily. It is more correct to swim where there is an equipped area with a permit, and it is more reasonable to cool down after exercise in the shower or in the pool," the lawyer concluded.

Evgenia Filippova, a lawyer at the Moscow Region Law Chamber, reported on April 26 that Russians could face a fine of up to 3,000 rubles for walking pets on equipped beaches. She explained that a direct ban on visiting recreation areas with pets is fixed in the rules for using beaches, approved by the order of the Ministry of Emergency Situations of Russia.
