On June 9, the Liberal Democratic Party submitted to the State Duma a bill on the abolition of administrative liability for citizens of the Russian Federation for late payment of fines. The text of the document is available to Izvestia.
It is proposed to amend note 1 to article 20.25 of the Code of Administrative Offences.
"The mechanism provided for in Part 1 of Article 20.25 of the Administrative Code of the Russian Federation for doubling the amount of a fine for late payment is excessive and unjustifiably repressive. At the same time, the disposition of the norm does not take into account either the financial situation of the violator or the fact of subsequent voluntary repayment of the debt," the explanatory note to the bill says.
As the authors of the initiative emphasized, current legislation leads to a situation where a person with temporary financial difficulties and a minor delay in a fine is penalized, which multiplies his debt to the state. At the same time, current regulations do not allow for a distinction between those who intentionally evade payment and those who are overdue but voluntarily repay the debt.
"In connection with the outlined draft law, it is proposed to establish that administrative liability for late payment of an administrative fine does not apply to citizens of the Russian Federation. <...> The proposed amendments apply exclusively to citizens of the Russian Federation, which allows maintaining the necessary severity of liability for foreign citizens and stateless persons located in Russia, taking into account migration and control aspects," the note says.
The party's leader, Leonid Slutsky, told Izvestia that the law should ensure order and discipline, and not turn into a mechanism for constantly increasing fines. In his opinion, it is important for the state to ensure compliance with the law, and not to create a system that people perceive as a way to replenish the budget at their expense.
"We consider it necessary to conduct a total audit of administrative regulations and create a list of delusional and unfair penalties, which today raise serious questions among people. The law should be strict but reasonable," stressed the head of the Liberal Democratic Party.
In March, LDPR leader Leonid Slutsky proposed the creation of a single digital complaint service for all cases of administrative offenses in "Public Services." He noted that now, instead of challenging an obvious mistake in a couple of minutes, citizens are forced to start "walking through torments" in order to prove their case. Today, Gosuslugi operates the Fine Appeal service, but through this mechanism it is allowed to appeal only fines for traffic violations. At the same time, the deputies want to extend this practice to all types of fines.
