The expert listed the valid reasons for absence from work
In Russia, the dismissal of an employee for absence from the workplace for a valid reason is not allowed. Tatiana Golubeva, Senior lecturer at the Department of Business, Labor and Corporate Law at the Presidential Academy, recalled this on June 1.
"The absence of an employee from the workplace for a valid reason during the entire working day (shift) or more than four hours in a row during the working day (shift) is not considered absenteeism, and the employer cannot apply disciplinary action to the employee in the form of dismissal on the specified grounds," she told TASS.
As the expert recalled, the Labor Code of the Russian Federation does not contain a list of valid reasons. However, emergencies can be recognized as such, as well as actions by government agencies that have caused transportation problems, including canceling or delaying flights, blocking the road to the workplace.
It is advisable for the employer not to apply disciplinary action in such a situation, since the absence of the employee was not his fault, Golubeva noted.
