Kamchatka furniture sellers were compensated for the use of Smeshariks

The Arbitration Court of the Kamchatka Territory has satisfied the claim of the copyright holders of the characters of the animated series "Smeshariki" to the individual entrepreneur and LLC "Kamchatka House of Furniture". It follows from the documents at the disposal of Izvestia on May 14.

The reason for the appeal to the court was the fact of illegal use on the website of images of the characters "Krosh", "Hedgehog", "Kar-Karych", "Owl" and trademarks registered in relation to furniture.

The court rejected the defendants' arguments that posting information on the site was not a public offer, and the product was not manufactured or sold. Since the use of each of the drawings and trademarks is an independent violation, the court sought compensation in the minimum amount of 10 thousand rubles for each object, as well as court costs and the cost of paying the state fee — only about 110 thousand rubles.

On March 13, the Moscow Arbitration Court dismissed a claim for the recovery of 2.09 million rubles from the Jam music publishing house. The lawsuit was filed by composer Leonid Velichkovsky. Earlier, he stated about the debt of the Jam publishing house, which is related to the use of musical works.
