The expert named a way to protect home buyers from losses
To protect bona fide buyers of real estate, it is necessary to change the procedure for challenging transactions and introduce additional guarantees. This was stated on April 24 by Sergey Sayapin, vice-president of the Guild of Realtors of Moscow, an expert in the field of real estate, at the Izvestia News center at a press conference "Fraud in the real estate market.": how to protect the rights of bona fide buyers?".
According to the expert, one of the possible solutions may be the introduction of a mandatory deposit when filing a claim for invalidation of the transaction. In this case, the party challenging the transaction must deposit the amount in advance to the court deposit, which will ensure a refund to the buyer in case of bilateral restitution.
The expert also noted the need for a clear division of responsibility between the seller and the buyer.
"It is clear that the tragedy of the seller, <...> who was deceived by fraudsters. We really feel for them, they are unhappy people. But you have to understand that these are unhappy people by choice, <...> and the buyer has nothing to do with it," he explained.
