In Moscow and the Moscow region, there are restrictions on carrying out noisy renovation work in residential buildings, but their time frames vary and are regulated by regional laws. Natalia Shaluba, a lawyer for land disputes and real estate, told Izvestia about this on April 21.

"There is indeed a daytime "quiet hour" for Moscow and the Moscow region, but this is not a single federal rule for the whole country, but a regional regulation," she noted.

According to the expert, in Moscow, noisy renovation work in apartment buildings is prohibited from 19:00 to 09:00, from 13:00 to 15:00, as well as on Sundays and holidays. Similar restrictions apply in the Moscow region, but the time frame differs and is additionally regulated by a separate law on silence.

"A violation of silence in this context is considered not only a "repair" in the everyday sense. We are talking about any actions that create increased noise at prohibited times: work with a drill, a hammer drill, drilling, dismantling, redevelopment, the use of other construction equipment," said the expert.

Shaluba stressed that the widespread claim of a fine of up to 80 thousand rubles is misleading. This amount applies to legal entities, while fines for citizens are much lower — in Moscow from 1 thousand to 2 thousand rubles, in the Moscow region — up to 2.5 thousand rubles. She added that management companies do not have the right to fine tenants on their own. Violations are recorded by authorized bodies, including the police and administrative commissions.

Ilya Vasilchuk, a judicial lawyer, an expert on the security of electronic transactions and real estate transactions, and a public figure, said on April 13 that smoking on a balcony is not directly prohibited in Russia, but in some cases it may entail administrative liability or legal disputes with neighbors. According to him, responsibility depends on the specific circumstances and consequences for others. One of the grounds for a fine may be a violation of fire safety regulations.
