Catering in kindergartens and schools with the help of a municipal food processing plant can lead to control problems, since a conflict of interest is initially built into this scheme, Evgeny Lando, general director of the Contract Systems law firm, said in a conversation with Izvestia.

"This is a tool by which the municipality tells its own institution: "You feed the children in our kindergartens and schools, we give you money from the budget for this." Relations are regulated by Federal Law No. 174 "On Autonomous Institutions" and Article 78.1 of the Budget Code of the Russian Federation. The law on the contract system (44-FZ) simply does not apply here, because formally there is no "purchase", there is financing of its own institution," the expert explained.

According to the lawyer, this is the way meals are provided in schools and kindergartens in the city of Odintsovo. It is handled by the municipal autonomous institution "Dobroye Cafe Food Processing Plant", which is founded by the administration of Odintsovo City district. UIA "Good Cafe" feeds children not on the basis of a contract, but as part of a municipal assignment.

The problem with such a scheme is a lack of control, Lando noted. When catering through a direct contract with a private contractor under 44-FZ, the contractor is financially responsible, can be included in the register of unscrupulous suppliers, and the selection takes place on a competitive basis, the lawyer recalled. None of these tools work for a municipal institution, since the municipal district administration is both the founder of the UIA and its controller.

Earlier it became known about cases of infection of children with salmonellosis in one of the kindergartens of Odintsovo. This is not the first case of intestinal infection in the city since the beginning of the year.
