Changes to the facade of an apartment building, including the installation of dryers or other structures, require the consent of the majority of owners and may entail liability in their absence. Dmitry Bondar, a public figure and housing and communal services expert, told Izvestia about this.

"The facade is a common property. This is explicitly stated in the Housing Code (paragraph 3, Part 1, Article 36 of the Housing Code of the Russian Federation) and the Civil Code (paragraph 1, Article 290 of the Civil Code of the Russian Federation). This means that any actions with it are possible only with the approval of the majority of residents," he said.

According to the expert, the placement of structures without approval may qualify as a violation of the rules for the use of residential premises. In this case, Article 7.21 of the Administrative Code of the Russian Federation applies, which provides for a fine for citizens in the amount of 1 thousand to 1.5 thousand rubles.

The expert explained that the management company or the HOA has the right to issue an order to dismantle the illegal structure. If the requirements are ignored, the issue can be resolved in court, and the costs of dismantling and court costs are borne by the owner. Depending on the region and the complexity of the case, they can range from 10,000 to 60,000 rubles or more.

He added that for the legal placement of objects on the facade, a decision of the general meeting of owners with the support of at least 2/3 of the votes is necessary. In some cases, additional coordination with the architecture and urban planning authorities is required if landscaping rules apply that limit changes in the appearance of buildings.

According to the expert, the absence of a formal resolution of the meeting is a key sign of a violation. Local regulations and technical regulations are also important, which may explicitly prohibit the mounting of various structures on facades without special permission.

Ilya Vasilchuk, a judicial lawyer, an expert on the security of electronic transactions and real estate transactions, and a public figure, said on April 13 that smoking on a balcony is not directly prohibited in Russia, but in some cases it may entail administrative liability or legal disputes with neighbors. According to him, responsibility depends on the specific circumstances and consequences for others. One of the grounds for a fine may be a violation of fire safety regulations.
