The Supreme Court of the Russian Federation pointed out the inadmissibility of penalties that deprive pensioners of their means of livelihood. This was announced on April 13 by the court's press service.
The reason for the trial was the case of a resident of the Ryazan region. The woman sought recognition of illegal deductions from her pension. From July to December 2023, about 40 thousand rubles of utility bills were collected from her, while her monthly pension is 13 thousand rubles.
The court of first instance partially satisfied the claims, but the appeal and cassation overturned this decision, pointing out that maintaining income at the subsistence level is possible only at the request of the debtor, which was not received.
"The pension authority, having information about the amount of the old—age insurance pension received by the applicant and about her lack of other income, made deductions in an amount that did not maintain the appropriate level of income for life support, and therefore the actions of the pension authority were recognized as illegal," the press service told RIA Novosti.
