Lawyer warned about fines for "swans" from tires in yards

The use of car tires to improve the surrounding area can lead to fines and even criminal liability. Sofya Lukinova, head of the Legal department of VMT Consult, told Izvestia about this on April 13.

"Car tires are waste that has no place in the surrounding area. They belong to the IV class of waste and, under certain conditions, may pose a threat to the environment. In particular, when heated in the sun, car tires can release toxic substances that negatively affect the soil and air," the expert emphasized.

She recalled that federal legislation prohibits the placement of waste of hazard classes I–IV in places where they can harm human health and the environment. In addition, the Land Code obliges land users to preserve soil fertility and protect it from pollution. Administrative liability is provided for violation of these norms. According to Article 8.2 of the Administrative Code of the Russian Federation, the fine for individuals ranges from 2 thousand to 3 thousand rubles, for legal entities — from 100 thousand to 250 thousand rubles.

Lukinova clarified that in some cases criminal liability is also possible, for example, if the use of tires has led to serious environmental damage, including groundwater pollution.

The exception is recycled materials. Thus, after special treatment, rubber crumb can be used to cover playgrounds and sports grounds, since it contains no toxic components.

The lawyer stressed that safe and environmentally friendly materials should be used for landscaping. Old tires must be disposed of through specialized licensed companies. It is forbidden to throw them on container sites.

She added that this rule also applies to other homemade structures made from waste, such as plastic bottles. In case of inaction of the management company, residents have the right to file a complaint with the supervisory authorities, including Rospotrebnadzor.

On the same day, Ilya Vasilchuk, a judicial lawyer, an expert on the security of electronic transactions and real estate transactions, and a public figure, noted that if smoking creates a risk of fire, for example, due to an unopened cigarette, this falls under Article 20.4 of the Administrative Code of the Russian Federation. In this case, the fine can range from 5,000 to 15,000 rubles.
