The receipt of funds by a civil servant for business consultations may become grounds for charges of bribery. This was announced on April 12 by lawyer Dmitry Grigoryadi, partner of the criminal practice of the law firm Korelsky, Ishchuk, Astafyev and Partners (KIAP).

"If you are in the civil service, forget about paid business consultations. Completely. The law allows scientific and teaching activities, but the payment must be commensurate with the market. If they offer an amount exceeding the annual salary of a professor for an hour—long lecture, this is most likely an operational development," he explained in an interview with TASS.

Grigoriadi added that receiving any property benefits for similar services, including discounts on real estate and vacation packages, falls under this charge. According to him, the Supreme Court regards this as bribes, even if the benefits are issued to relatives, and Rosfinmonitoring monitors all transaction chains.

In addition, according to the resolution of the plenum of the Supreme Court, to which the expert refers, even those funds that were received under an official contract for the provision of services can be defined as a bribe. Thus, any property benefits obtained in connection with an official position are considered a bribe. In this case, the fact that the recipient of the services works in the sphere of influence of a particular official is sufficient for the evidence base.

The lawyer also stressed that criminal liability can also overtake businesses that purchase consulting services. This corresponds to Article 291 of the Criminal Code of the Russian Federation ("Giving a bribe").

Mikhail Avdeenko, deputy chairman of the All-Russian Trade Union of Education, warned on December 21 that a New Year's gift to a teacher should not cost more than 3,000 rubles, otherwise it could be regarded as a bribe. According to him, such a limit is set by the norms of the Civil Code of the Russian Federation. The legislation does not contain a clear definition of the term "gift", but the number of gifts that can be given to a teacher is unlimited. If the parents decide to donate several items, the rule of 3 thousand rubles applies to each item separately.
