Peeling an onion in a store without buying a product can be considered as damaging it and entail administrative liability. Sofya Lukinova, head of the Legal department of VMT Consult, told Izvestia about this on April 9.
"Peeling onions in a store without buying the onion itself can really be regarded as spoiling the product, as the appearance of the product deteriorates. The Administrative Code of the Russian Federation has a corresponding article 7.17 — for the destruction or damage of other people's property, for example, for a broken window. The fine can range from 300 to 500 rubles," the expert explained.
If the visitor decides to take out the cleaned product without paying for it in full, this may qualify as petty theft. In accordance with art. 7.27 of the Administrative Code of the Russian Federation, the fine in this case will be at least 1 thousand rubles.
The expert noted that stores have the right to set their own rules of behavior in the trading floor. The administration may require payment for the entire product if the buyer's actions have made it unfit for sale.
At the same time, the argument that the husk is a waste does not absolve from responsibility. As Lukinova emphasized, in this case we are talking about a violation of the integrity of the product, similar to opening the package or damaging the product.
In the event of a dispute, the store must prove the fact of intentional damage, for example, using CCTV footage. At the same time, the employees of the outlet have no right to detain the buyer or apply pressure to him.
