Lawyer Alexander Khaminsky estimated the likelihood that singer Larisa Dolina could be ordered to pay almost 8 million rubles for involving bailiffs in her eviction.

In conversation with aif.ru On Tuesday, January 27, the specialist explained that after Dolina handed over the decision to initiate enforcement proceedings, she had five days to voluntarily comply with the requirements of the writ of execution. Otherwise, she could be charged a performance fee in the amount of 7% of the value of the property. In the case of an apartment worth 112 million rubles, this amount would amount to 7.84 million rubles.

He recalled that the enforcement proceedings were initiated on January 12, and the singer handed over the apartment to Polina Lurie on January 19 — on the seventh day. However, according to the lawyer, the key question is when exactly the Valley sent the resolution. The document could have been sent later on January 12, and she was outside of Russia at the time. It is also important whether the notification was sent by regular mail or registered mail.

Khaminsky noted that under such circumstances, there might not have been a delay. He also admitted that Dolina's lawyer could have notified the bailiffs in advance of her readiness to hand over the keys and agree on a date. If the bailiffs scheduled the transfer for January 19, then there are no grounds for collecting the enforcement fee: the property was transferred within the time limit set by them.

Lurie's lawyer Svetlana Sviridenko said on January 22 that the plaintiff was preparing an application for recovery of court costs from Dolina. In particular, we are talking about the payment of state duties, expenses for lawyers' services and a report on the valuation of the apartment price. 360.ru . The next day, the singer's lawyer, Maria Pukhova, stated that Dolina regularly paid for housing and communal services, writes RT. The lawyer stressed that Dolina fulfilled her financial obligations to maintain housing in full throughout the entire period of the trial.
