The lawyer explained the new rules for issuing family mortgages from February 1, 2026

Starting from February 1, 2026, the "one family, one preferential mortgage" principle will come into force in Russia, under which spouses will be treated as one borrower, regardless of who the loan is issued to. The new rules are aimed at eliminating the reuse of benefits by the same family. Irina Gritsenko, a lawyer at the Legal Policy Bar Association, told Izvestia about this.

According to the lawyer, the innovation is based on the legal understanding of the family as a single entity of property and credit obligations.

"The "one family, one preferential mortgage" rule establishes an approach in which spouses and their children are treated as a single loan entity. In accordance with Articles 34 and 45 of the Family Code of the Russian Federation, the obligations of spouses are common, so it is the family as a whole that has the right to receive a preferential mortgage," Gritsenko explained.

The expert noted that from February 1, 2026, both spouses are expected to participate as co-borrowers on the family mortgage. This will eliminate situations in which each of the spouses individually applies for a preferential loan.

Hrytsenko stressed that previously received preferential mortgage loans will also be taken into account when considering new applications.

"The fact that the family participated in the program before February 1, 2026, may become grounds for refusing to re-grant the family mortgage. In this case, it will matter whether the applicant or his spouse acted as a borrower or co—borrower under the previous agreement," she said.

The lawyer clarified that verification of the availability of previously issued preferential mortgages will be carried out through credit bureaus, internal databases of banks and information about government mortgage programs. However, she did not rule out possible technical errors.

"If the co—borrower's status is incorrectly reflected in the credit history or the data is updated with a delay, the borrower has the right to apply for correction of the information," Hrytsenko said.
