A bill has been submitted to the State Duma to protect against the "Valley effect"
Mikhail Delyagin, Deputy Chairman of the State Duma Committee on Economic Policy, has submitted to parliament a bill that excludes the recognition of a real estate transaction as invalid if the buyer did not know about fraud on the part of the seller organized by third parties. The text of the draft law was posted on the Duma electronic database on January 19.
"The bill is aimed at eliminating the legislative gap identified in law enforcement and judicial practice when challenging transactions made under the influence of deception by third parties (the so—called "chargeback" sales or the "Valley case")," the explanatory note says.
It is proposed to amend the Civil Code of the Russian Federation by adding a provision according to which a real estate transaction cannot be declared invalid if the buyer did not know about the fraud of third parties. In this case, the buyer will be considered bona fide until proven otherwise.
