If a criminal case is initiated under the article "Negligence" after the tragic events in the Novokuznetsk maternity hospital No. 1, the staff may be punished with forced labor for up to five years, deprivation of the right to engage in certain activities for up to three years or imprisonment for up to seven years. Civil lawyer Alla Georgieva told Izvestia about this on January 13.

She also drew attention to the fact that the article "Negligence" refers more to the staff. According to the lawyer, under the article on causing death by negligence, the penalty can be up to four years in prison. At the same time, according to Georgieva, Article 238 of the Criminal Code of the Russian Federation, which concerns the provision of services that do not meet safety requirements, may be applied to the hospital's management.

Georgieva stressed that the investigation must carry out thorough work to ensure that the punishment is fair, and in case of errors in the investigation, this may become the basis for the cancellation of the verdict. As part of the case, victims can file a civil claim against a medical institution.

"It is absolutely necessary to request job descriptions in order to understand exactly what the employee was supposed to do. There are cases when an employee has been hired for one position, but he performs completely different duties," the lawyer noted.

Georgieva also noted the importance of reviewing the medical records of women in labor to determine their condition upon admission. She added that doctors can justify themselves by claiming that what happened was not a medical error, but the result of women's health conditions.

On the same day, obstetric hospital No. 1 of the G.P. Kurbatov City Clinical Hospital No. 1 in Novokuznetsk temporarily stopped receiving patients. It was noted that this decision was made due to the excess incidence of respiratory infection.

Later, it was reported that nine babies died in the hospital. In addition, the UK confirmed the death of newborns. A criminal case was opened into the incident under Part 3 of Article 109 of the Criminal Code of the Russian Federation ("Causing death by negligence"), Part 3 of Article 293 of the Criminal Code of the Russian Federation ("Negligence").

In turn, the governor of Kuzbass, Ilya Seredyuk, temporarily dismissed the chief physician of the Novokuznetsk maternity hospital. The source of Izvestia reported that all infants were diagnosed with either an intrauterine or neonatal infection, which gave critical complications.
