The procedural law allows for a delay in the execution of a judicial act, lawyer Alexander Khaminsky, head of the Law Enforcement Center in Moscow and the Moscow Region, said on Thursday, December 25, commenting on the court's decision to evict singer Larisa Dolina from a five-room apartment in the Khamovniki district.
Khaminsky said that after making a decision, the court that reviewed the case has the right to postpone or delay the execution of the court's decision on the applications of the persons involved in the case, based on the property status of the parties or other circumstances. According to him, Dolina will be able to file such an application after the Moscow City Court has issued a judicial act. She will have to justify why she is unable to execute the decision immediately and provide relevant evidence.
"The grounds for changing the method and procedure for executing the decision are circumstances that cannot be eliminated at the time of applying to the court, indicating the impossibility or extreme difficulty of executing the court decision by the debtor-citizen," the lawyer explained in a conversation with Lenta.Ru .
He added that Dolina had time to start taking things out of the apartment, given that the Supreme Court made the final decision on the ownership of the apartment on December 16. However, taking into account the specific circumstances, the court may meet her halfway and postpone the eviction for a reasonable period of time, the lawyer concluded.
On the same day, the Moscow City Court satisfied Lurie's demands and decided to evict Dolina from a five-room apartment in the Khamovniki district, RT reports. Subsequently, the actress left the apartment in Khamovniki.
Earlier, Lurie's lawyer said that Dolina had asked her to live in an apartment in Khamovniki for a few more months.
