Singer Larisa Dolina's delusion at the time of the apartment sale is not a sufficient reason to cancel this transaction. This is stated on December 21 in the text of the Supreme Court of the Russian Federation on the complaint of the buyer of the apartment Polina Lurie.

"Not every mistake is recognized as a defect in the transaction, but only a significant one, that is, in the absence of which the party, reasonably and objectively assessing the situation, would not have made the transaction at all. Revealing the concept of the materiality of a misconception, the legislator in paragraph 2 of Article 178 of the Civil Code provides an open list of circumstances regarding which he considers the misconception to be significant, deserving, if there are other prerequisites, to be the basis for recognizing the transaction as disputed (invalid)," TASS cites the text of the document.

According to the document, these circumstances also include typos or typos in documents, doubts about the subject of the transaction itself or about the person with whom the transaction is concluded. In addition, paragraph 3 of the same article states that a misconception about the motives of a transaction is not considered grounds for invalidating it.

On December 16, the Supreme Court of the Russian Federation recognized ownership of the disputed apartment as Dolina za Lurie. It was clarified that the court also decided to cancel all decisions of the lower courts in the case of the sale of the apartment of the artist.

Lurie's lawyer Svetlana Sviridenko, in turn, said that Dolina continues to stay in the Moscow apartment, which the Supreme Court of Russia recognized as the property of the buyer. According to her, the singer can voluntarily leave the apartment before the meeting.

Later, on December 19, Dolina, after receiving a request for eviction from the apartment from her new owner Lurie, reported the fraud to the police. The singer contacted the police on August 3, 2024, only after that a criminal case was opened and she was recognized as a victim.
