- The lawyer allowed the Moscow City Court to make a decision on Dolina's eviction from the apartment
It is likely that the Moscow City Court, upon further consideration of the case of the disputed apartment, will decide on the eviction of the People's Artist of the Russian Federation Larisa Dolina. Dmitry Nosov, Associate Professor of the Department of Civil Law at Kutafin Moscow State Law University, announced this on Tuesday, December 16.
The lawyer noted that the Supreme Court of the Russian Federation had sent the issue of Polina Lurie's demands for Dolina, her daughter and granddaughter to be evicted from the apartment for a new hearing to the Moscow City Court of Appeal. Most likely, with a new review of Lurie's claim, the court will satisfy the plaintiff's claims, since the Supreme Court of the Russian Federation actually recognized Lurie's ownership of the disputed apartment, he added.
"The decision of the Supreme Court of the Russian Federation came into force immediately after its announcement, so Polina Lurie has the legal right to use the disputed apartment at her discretion," Nosov told the Moscow City News agency.
The expert noted that the decision of the Supreme Court may still be reviewed in a supervisory instance — the Presidium of the Supreme Court of the Russian Federation, or the case may be referred to the Constitutional Court of the Russian Federation if the Dolina side decides to challenge it.
On December 16, the Supreme Court of the Russian Federation recognized the ownership of the disputed apartment as Dolina za Lurie, reports NSN. In addition, the court also decided to cancel all decisions of the lower courts in the case of the sale of the apartment of the artist, reports 360.ru .
Dolina did not come to the Supreme Court on December 16 to consider the complaint of the buyer of her apartment. During the trial in the case of the sale of the apartment by Dolina, it became known that the initial value of the property was 130 million rubles. The parties came to the cost of 112 million rubles during the negotiations.
In March 2025, the Khamovnichesky District Court of the capital considered the counterclaims of the singer and Lurie and ruled in favor of Dolina. More than 69 million rubles were recovered in favor of the actress.
Lurie's appeal was dismissed on September 8. The Moscow City Court recognized the decision on ownership of the disputed apartment for Dolina, her daughter and granddaughter as legitimate. On November 27, the Second Court of Cassation rejected Lurie's complaint and again retained ownership of the property for the artist.
Lurie filed a complaint against the decisions of the lower courts to the Supreme Court. In her lawsuit against the buyer of the apartment, the singer stated that she had not shown reasonable care when concluding the transaction. At the same time, Lurie had no doubts about the singer's sanity. The girl's lawyer said that she rejected Dolina's offer of a settlement agreement as unacceptable.
