- The Supreme Court overturned the decision in the case of the sale of Larisa Dolina's apartment. The main thing
On December 16, the Supreme Court of Russia overturned the lower court's decisions on the dispute over the sale of the apartment of People's Artist of Russia Larisa Dolina and sent the case for a new hearing. The court began to study the complaint of the customer Polina Lurie, recognizing the need to re-examine the circumstances of the transaction. All the details are in the Izvestia article.
Review of the case
The Supreme Court of the Russian Federation has overturned all previous court decisions in the case of the sale of Larisa Dolina's apartment in Khamovniki and sent the dispute for a new hearing to the court of first instance. This means that the conclusions of the lower courts have become invalid, and the parties will be able to present their arguments and evidence again.
The meeting was held in an open mode. The court rejected the request of Dolina's representative to close it, citing the significant public outcry of the case.
Lurie's defense position
The buyer of the apartment, 34-year-old single mother Polina Lurie, appealed to the Supreme Court, insisting on recognizing the legality of the sale. She also filed a counterclaim for the forced eviction of the actress from the apartment.
Lurie's defense claims that the transaction was legally clean and fully paid for. According to the lawyer, Larisa Dolina personally communicated with the customer for about two hours, discussed the details of the stay and wrote a receipt in her own hand, counting the cash several times. The cost of the apartment was initially 130 million rubles, but the parties agreed on a price of 112 million.
The fraud version
People's Artist of Russia Larisa Dolina did not participate in the Supreme Court session, her interests were represented by lawyer Maria Pukhova. The defense insists that the singer was a victim of phone scams and did not realize the real nature of the transaction.
"My client was under the influence of fraudsters and believed that she was participating in a special operation, and therefore the transaction is fictitious," said Maria Pukhova.
According to her, Dolina was sure that after the arrest of the criminals, the deal would be canceled by the state.
The lawyer also confirmed the artist's willingness to return 112 million rubles to Polina Lurie, but stressed that the defense strongly objects to the singer's eviction from the apartment. At the same time, according to Dolina's side, the persons who actually received the money, that is, fraudsters, should return the money.
Further steps
During the meeting, the prosecutor's office opposed the forced eviction of Larisa Dolina and the return of the apartment to the buyer, pointing out possible violations by the courts, which had previously refused Lurie monetary compensation.
The cancellation of the decisions and the referral of the case for a new hearing means that the court of first instance will re-evaluate the circumstances of the transaction, the degree of awareness of the actions of the parties and the legal consequences of possible fraud.
