From the point of view of labor law, an employer is not obligated to invite all employees to a New Year's corporate party. This was stated on December 16 by lawyer Ilya Rusyaev in an interview with RT.
According to him, if the number of corporate party participants is limited due to factors such as room capacity, security requirements or budget, the organizers have the right to choose their circle. At the same time, the expert noted that exclusion from the event can be perceived as punishment, for example, for conflict or refusal to go to work on a day off.
"In the disciplinary system of the Labor Code of the Russian Federation, the list of penalties is limited: remark, reprimand and dismissal on established grounds. "Corporate deprivation" is not included there," the expert reminded.
If work events such as meetings, briefings or training are held under the guise of a corporate event, mandatory attendance at them may be regarded as working hours, Rusyaev added. This, according to him, entails corresponding consequences "for registration and payment."
Earlier in the day, analysts at the consulting company get experts said that in 2025, 35% of Russian companies do not plan to hold New Year's corporate events. It was clarified that in 10% of cases the budget is 2-5 million rubles, and 4% of companies are ready to spend more than 10 million. The majority of employers (60%) who confirmed the celebration chose an on-site format, and 31% organize it in the office.
