The State Duma proposed tougher penalties for hooliganism on the road
A bill has been submitted to the State Duma to strengthen responsibility for hooliganism in transport. The document was published on December 12 on the website of the State Duma.
A group of deputies led by Yaroslav Nilov, Chairman of the Committee on Labor, Social Policy and Veterans' Affairs, proposes to supplement the first part of Article 213 of the Criminal Code of the Russian Federation with paragraph "d" defining the signs of a new corpus delicti. It is a question of committing hooligan acts by a person driving a vehicle, or against a person driving a vehicle.
An act of vandalism, aggressive behavior of drivers or other persons towards drivers can lead to massive violations of traffic rules, accidents and even human casualties, the authors of the bill believe.
"Classifying hooliganism in cases where drivers are the guilty or injured party as a criminal offense will not only prevent crimes and eliminate threats to the life and health of citizens, but also create a safer environment for all road users, as well as in residential areas and parking lots, which, of course, meets the interests of society as a whole.", — it is reported in the explanatory note to the document.
Article 213 of the Criminal Code of the Russian Federation provides for criminal liability for hooliganism. It is understood as a gross violation of public order, expressing clear disrespect for society, committed: with the use of violence against citizens or the threat of its use; motivated by political, ideological, racial, national or religious hatred or enmity, or motivated by hatred or enmity against any social group; on railway, sea, inland by water or air transport, as well as on any other public transport.
For these actions, a fine is provided in the amount of 300 thousand to 500 thousand rubles or in the amount of wages or other income of the convicted person for a period of two to three years, or compulsory labor for up to 480 hours, or correctional labor for a period of one to two years, or forced labor for up to five years., or imprisonment for the same term.
