The lawyer spoke about criminal liability for peeping into someone else's phone
Viewing the contents of a phone without the owner's consent is a criminal offense. Such peeping falls under the scope of Article 137 of the Criminal Code of the Russian Federation and involves up to 4 years in prison. Lawyer Yana Vorobyova told Izvestia about this on November 25.
"Article 137 of the Criminal Code of the Russian Federation does provide for liability for violation of privacy. And situations may fall under it when a person gets access to someone else's personal information, including peeking at the contents of the phone without the consent of the owner," Vorobyova explained.
According to the expert, in itself, illegally obtaining information about private life is already a crime and can result in a penalty of up to two years in prison, and if such information was passed on to third parties or disseminated in any form, the term may increase to four years. The lawyer stressed that sending screenshots, showing correspondence, or publishing photos and videos only increases responsibility.
Vorobyova noted that evidence in such cases may include recordings showing a person filming or photographing someone else's screen, materials found in the possession of third parties, correspondence with confessions, as well as witness statements. To begin the proceedings, the victim must file a police report.
She added that if the information received contains expressions discrediting honor and dignity, it is possible to file a claim for compensation for moral damage in the framework of civil proceedings.
Alexey Yurasov, Doctor of Physico-Mathematical Sciences, Professor of the Department of Nanoelectronics at RTU MIREA, said on November 9 that light of any intensity, including radiation from smartphone, tablet and computer screens, can reduce melatonin levels, which affects circadian rhythms. According to him, blue light with a wavelength of about 450-480 nanometers affects the photoreceptors of the retina, disrupting the production of a hormone that regulates sleep.
