The court refused to compensate a Muscovite woman who suffered from botulism after ordering a scooter.

The court dismissed a claim for compensation for moral damage to Muscovite Nelly Matveeva, who claims that she suffered botulism after eating products purchased through the Scooter delivery service. This was reported on September 23 by a correspondent of Izvestia.

Representatives of Smart Retail LLC (Samokat service) throughout the entire process expressed their willingness to conclude an amicable agreement, but the proposed amount of compensation did not suit the plaintiff.

Matveeva's claims were rejected in full. The woman referred to the severe health consequences she faced after poisoning. According to her, initially, doctors could not diagnose botulism, suggesting that she had heart problems. Only after his condition worsened, when other cases of poisoning became known, was he diagnosed and resuscitated.

The defendants, in turn, cited the arguments of their specialist, who stated that the woman had never had botulism.

In December 2024, the first substantive court hearing on this claim was held. During the court session, it became known about the intention of Smart Retail to conclude a settlement agreement, but the victim was not satisfied with the amount of compensation. Later, the court involved a bean producer as a third party in the claim of the victim of botulism.

In June last year, Rospotrebnadzor launched an investigation after cases of poisoning and suspected botulism in Moscow. The head of the department, Anna Popova, said that the total number of people infected with botulism was 417 in several regions of Russia, two died.

All the victims ate Lobio salad from the manufacturer Lokalkitchen LLC ("Kitchen in the area") or salad with tuna, apple and beans from Gastroport. After the mass poisoning, the activities of the Kitchen in the Area and the bean producer Savon-K were suspended. A criminal case was initiated under Article 238 of the Criminal Code of the Russian Federation ("Provision of services that do not meet the requirements for the safety of life and health of consumers").
