After a judicial assessment of the actions of the ex-striker of the football club (FC) Krasnodar Fedor Smolov, the athlete may face a real term. Evgeny Krivtsun, a member of the Russian Bar Association, shared this opinion with Izvestia on September 10.
"The maximum that he can face is actual imprisonment by analogy with [football player Alexander]. Kokorin and [his colleague Pavel] Mamaev, who were sentenced to real time and served their sentences in a correctional facility," the lawyer explained.
According to him, the most severe measure that can be imposed on a football player is imprisonment for a term of 5-6 years with serving a sentence in a general regime colony. He stressed that the court must understand all the circumstances of the incident. If no corpus delicti is found in Smolov's actions, the criminal case will be dismissed, Krivtsun said.
The initiation of a criminal case under Part 1 of Article 112 of the Criminal Code of the Russian Federation ("Intentional infliction of moderate harm to health, not life-threatening") against a football player became known on September 10. Smolov's wife Karina Istomina declined to comment on her husband's criminal case to Izvestia. According to her, it was aroused "because it happened that way." The girl declined to comment further.
Smolov came into conflict with two visitors to a Moscow restaurant in late May, but footage of the incident appeared online only on July 5. It was noted at the time that the cause of the conflict was unknown, but there were suggestions that the player had been provoked.
Businessman Andrey Popelukha, who became a participant in the fight, told Izvestia at the same time that the conflict between the two men at Kofemania and Smolov occurred after they refused to have the athlete pay their bill amid the noisy behavior of his company. The athlete's wife, Karina Istomina, reported that Smolov, after a conflict with customers in a cafe, repented and apologized to the victims, and also offered to pay them compensation.
