The use of artificial intelligence (AI) has real legal risks associated with possible copyright infringement. He told the Newspaper about this on September 6.Ru" Dean of the HSE Faculty of Law, Professor Vadim Vinogradov.

"According to Articles 1228 and 1257 of the Civil Code of the Russian Federation [Civil Code of the Russian Federation], the author can only be a person who created the work himself thanks to his creative work. Artificial intelligence, even the smartest one, is not considered an author," the expert said.

He added that if a person's action consists only in setting an AI task. this will not be considered as a project that will be recognized as an object of copyright.

At the same time, Vinogradov noted that if a person carries out a complex iterative process, such as formulating a detailed request, editing and creatively refining the result, then such an activity can be regarded as a creative contribution sufficient to create authorship for the user.

According to the professor, the legal problem lies in the very principle of neural networks.

"AI systems create new content by analyzing millions of existing texts, images, and program codes. However, they often reproduce fragments of copyrighted materials without specifying the sources. In practice, this means that content created with the help of AI may infringe on someone's copyrights," the publication says.

It is especially risky to use such materials for commercial purposes, since the responsibility will be borne not by the developer of the neural network, but by the one who publishes and uses controversial content.

"In order to minimize legal risks, it is recommended not only to document the content creation process (save requests, versions and edits), but also to apply an integrated approach," concluded Vinogradov.
