The Russian government has finalized a draft law that describes a special mechanism for bringing to justice certain traffic violators. The amendments are designed to eliminate double penalties for road accidents, and the new version of the document was approved by the Cabinet of Ministers at a meeting on September 4, Kommersant reports.

Earlier, the Constitutional Court of the Russian Federation found that the Administrative Code allows twice for the same violation to bring to justice motorists who caused damage to the health of other road users. Although it is contrary to the Constitution.

The precedent was the situation with a driver from the Saratov region who ran over a child during an accident. First, the driver was fined under Article 12.18 of the Administrative Code (failure to provide an advantage to pedestrians), then the court deprived him of his rights under Article 12.24 of the Administrative Code (violation resulting in minor or moderate injury to health).

It is assumed that if the amendments come into force, the final decision on which article to punish the driver will be made by the courts. In the case of an accident causing harm to human health, the State Traffic Inspectorate sends to the court a protocol on violations under Article 12.24 of the Administrative Code, as well as materials on other violations that were recorded in connection with the accident.

The courts will have the right to demand materials from the traffic police if they have not been received. If it turns out that an administrative case has already been initiated against a citizen, the court will choose which one to suspend the proceedings or cancel the fine that has already been imposed, and which one to continue. While the court is waiting for the materials, the statute of limitations for prosecution and the deadline for payment of a fine (if the traffic police has already issued a ruling on another article of the Administrative Code) are suspended.

Earlier, on September 3, the State Duma offered to replace state automobile registration plates free of charge, which do not have the Russian tricolor, with those with the image of the flag. The initiative "will reduce the number of disputes and risks for bona fide car owners, as well as help to curb the turnover of duplicates that do not meet the updated standard," its author is confident.
