A bill on joint parenting after a divorce has been submitted to the State Duma
Deputies Andrey Svintsov (LDPR), Dmitry Kuznetsov (SRZP) and Alexey Kornienko (KPRF) have submitted to the State Duma (State Duma) a bill on joint parenting of children after a divorce. Information about this appeared on August 4 in the electronic database of draft laws of the State Duma.
The law proposes to supplement the Family Code with a new article that will regulate the conditions and procedure for co-parenting a child. In the absence of an agreement between the spouses on who the child will stay with after the divorce, the court will be able to establish the procedure for joint upbringing at its discretion.
According to the document, when establishing co-parenting, the court determines the individual schedule of the child's stay with each of the parents. The time spent by the child with each parent will be distributed equally. The child's opinion is taken into account when he reaches the age of ten. Parents also have the right to conclude a written agreement on other conditions of joint education.
Co-parenting cannot be ordered by a court if one of the parents does not have a place of residence or lives abroad. He will also not be appointed in the absence of parental rights or in a situation where leaving a child with one of the parents is life-threatening.
In addition, among the cases in which it is impossible to establish co-parenting, the child's chronic illness, the parents' work schedule (shift work, long business trips), and long distances between the parents' places of residence are indicated. The court may also decide on the impossibility of co-parenting, based on the conclusion of the guardianship authorities after examining the child's living conditions.
"The introduction of the institution of co—parenting may become a factor contributing to the responsible approach of spouses to the decision on the dissolution of marriage, as it implies the need for their further constructive interaction in the interests of the child," the explanatory note to the bill says.
On July 25, deputies of the State Duma drafted a bill according to which parents of schoolchildren will be paid annually an amount equal to the subsistence minimum before the start of the school year. According to the law under consideration, a payment is proposed for each student in the family.
