A driver who has been involved in a traffic accident has no right to consume alcoholic beverages, even if the other car owners have no claims against him and he is the only participant in the accident. This is stated in the ruling of the Supreme Court (SC) of the Russian Federation, the Russian Agency for Legal and Judicial Information (RAPSI) reports.

The Supreme Court considered the complaint of a driver from Karelia, who was deprived of his license for 1.5 years with a fine of 30 thousand rubles. It was established that he damaged the car by driving off into a ditch, after which he consumed alcohol. The author of the complaint pointed out that the owner of the car has no claims to the driver, and there were no other victims in the accident.

The Supreme Court recalled that, according to the traffic rules, if there is no disagreement with the owner of the car after the accident, the driver is obliged to draw up the relevant documents in accordance with the rules of compulsory insurance without the involvement of the police. However, the case materials do not contain such documents. In this regard, the Supreme Court of the RF considered that the courts correctly qualified the actions of the driver, who himself did not deny that he had consumed alcohol after the accident, and with the result of the examination was agreed.

December 6, it was reported that, as recognized by the Supreme Court, the driver, who is in a drunken state, has no right to get behind the wheel , even if asked to do so by a traffic police officer. The Supreme Court considered the case of a driver who was deprived of his license for drunk driving. He insisted that he did not intend to get behind the wheel, but was forced to do so on the instructions of a traffic officer.
