The State Duma reported on the impact of holidays on the size of wages in January
The New Year holidays will not affect the amount of fixed salary, as the employer is obliged to pay the established monthly salary in full. This was reported to "RIA Novosti" on January 8 by State Duma deputy Sergei Gavrilov from the CPRF party.
"For employees who have a fixed salary, long weekends do not affect the amount of wages. This is clearly stated in Article 112 of the Labor Code of the Russian Federation, which states that the presence of non-working holidays in the month does not reduce the amount of salary," - said the interlocutor of the agency.
According to Gavrilov, the salary can be reduced for citizens who receive a salary that depends on the actual time worked or the amount of work performed. So, if an employee works less than usual in January, his earnings may be reduced.
The deputy noted that the advance paid in the middle of the month may be lower than usual. This is due to the fact that the calculation of payment, as a rule, is based on the first working days of the month, and in January they are few.
Gavrilov emphasized that in situations where employees work on holidays, their pay should be increased.
Earlier, on January 2, Alexander Yuzhalin, head of legal practice at SuperJob, told Izvestia how the two-day work week will affect wages. The long weekend should not affect the wages of workers who have a fixed salary. In accordance with Article 112 of the Labor Code of the Russian Federation, the presence of non-working holidays in a month does not affect the salary. Accordingly, such employees will not lose money, the expert explained.
Before that, on December 26, it was reported that in the New Year holidays 40% of Russians surveyed will work. This is stated in the results of a study of services Work.ru, "Podrabotka" and analysts of the media holding Rambler & Co. In this case, 26% plan to work at the main place, 8% will combine the main employment with additional work, another 6% - only part-time. Respondents plan to earn money during the holidays as drivers (13%), which reflects the demand for transportation services in the pre-New Year period. Security guards (8%) and couriers (6%), as well as construction and laborers (5%) remain in demand.
