They will shed excess: Russia will ban the sale of dietary supplements without state registration on marketplaces
The authorities intend to ban the sale of dietary supplements without state registration on marketplaces as early as September 1, 2025. This is stated in the draft law of the Ministry of Economic Development and Trade "On the platform economy in the Russian Federation", which was reviewed by Izvestia. Which dietary supplements will be banned from being sold on marketplaces
The government apparatus sent to the departments for approval a fresh version of the bill "On platform economy", it is about a new regulation for marketplaces. The document was formed by the Ministry of Economic Development, "Izvestia" got acquainted with it. According to the idea of the authorities, the law will take effect from September 1, 2025. In addition to other norms, the agency proposed to introduce a ban on the sale of certain products on aggregators. This applies, for example, to illegal goods, as well as biologically active supplements (BAA), which have not confirmed their quality and safety, that is, have not received documents of state registration.
State registration of biologically active supplements is mandatory in theterritory of all EAEU member states, according to the technical regulation "On the safety of food products," recalled "Izvestia" in Roskachestvo.
But there are no restrictive rules regarding online trade now, as well as sanctions for the sale of products that have not passed state registration. Sellers themselves can remove such goods, it can also be blocked by marketplace employees. Violation of this requirement threatens entrepreneurs, carrying out activities without forming a legal entity, with a fine from 50 thousand to 100 thousand rubles; for legal entities - from 100 thousand to 300 thousand. Repeated - up to 500 thousand rubles, follows from the amendments of the Ministry of Economic Development to the CAO.
Consumption of dietary supplements that have not passed state registration can be extremely dangerous to health, they may contain banned substances, explained "Izvestia" in the Ministry of Economic Development. Therefore, the draft federal law "On Platform Economy" stipulates the obligation of marketplaces not to allow the placement of offers to sell such supplements.
- For failure to fulfill this requirement, platforms will be liable in case of harm to the consumer, as well as administrative responsibility in case of detection of violation of the specified norm, - noted in the Ministry. - Similar requirements are proposed for other "sensitive" categories of goods subject to state registration and capable of causing significant harm to the consumer, including medicines, pesticides and agrochemicals.
In May-June 2024, Roskachestvo assessed compliance with the law when selling dietary supplements on domestic aggregators and found a number of violations: supplements were presented without a certificate of state registration, prohibited substances were found in their composition, experts recorded an increased content of active substances, plus the sites were selling prescription drugs under the guise of dietary supplements.
According to the National Union of Consumer Rights Protection, the share of dietary supplements without state registration in the market reaches 60%, mainly weight loss supplements. "Izvestia" found similar offers on all major marketplaces - for example, supplements from Korea are sold without state registration.
How marketplaces protect consumers from dangerous dietary supplements
Dietarysupplements are one of the types of specialized food products that are subject to mandatory conformity assessment in the form of state registration, in Russia, such registration is carried out by Rospotrebnadzor, which also controls this market, the service reminded Izvestia. The sale of additives on marketplaces without supporting documents is not allowed, they added.
- In case of violation of mandatory requirements Rospotrebnadzor takes measures, including suspension of realization of unsafe food products in circulation," the service added. - Since November 1, 2024, a new mechanism has also been working - unsafe dietary supplements cannot be punched at the cash register, this approach has already shown its effectiveness. More than 7 million supplements containing substances banned in production have not been put on sale.
"Izvestia" sent inquiries to the largest domestic manufacturers of supplements, at the time of publication they did not respond.
Market participants claim: they already strictly control the sales of dietary supplements on their sites. For example, Wildberries pays special attention to the safety and quality of products presented on the platform, the company told Izvestia. In 2022, the marketplace conducted a full integration with the register of certificates of state registration of dietary supplements and vitamin complexes of the Eurasian Economic Commission. Sellers must attach documents for goods, the authenticity of which is confirmed by verification with the official state register. Only after that, dietary supplements appear on the online storefront, the company said.
- Wildberries has already prevented the appearance and further realization on the platform more than 3.5 thousand cards of goods - they did not have a certificate of state registration. The consumer can check the number of the certificate in the card in the section "Characteristics and Description", - emphasized in the company. - In addition, we constantly check the showcase of the marketplace for the presence of prohibited goods on the platform, in case of their detection, we immediately block such cards, not allowing them to be sold on the platform.
Ozon has already implemented a multi-level control mechanism to protect the consumer: the site prohibits the sale of dietary supplements without a certificate of state registration - the document is checked manually, only then the goods are put on sale, the company said. In addition, they also check the presence of marking codes for dietary supplements produced or imported into the Russian Federation from October 1, 2023 before placing them in their warehouses.
- This year we have significantly strengthened measures to combat unscrupulous sellers who try to circumvent the rules of the site and place goods in other categories. In addition to regular manual checks of the entire assortment and with the help of automated search, we have introduced an additional measure: since the end of October, we have fixed a ban on the sale of any food products that contain substances from the list of prohibited substances for the category of dietary supplements, - said the organization.
Indeed, the problem of selling illegal products on marketplaces is quite acute, dietary supplements are in the zone of special risk, as they have a direct impact on the health of consumers, said the head of the "Public Consumer Initiative" Oleg Pavlov. Since the introduction of mandatory labeling in this category and the emergence of new control tools, the situation has begun to improve. If these products have not passed the mandatory registration procedure, they should not be sold to consumers either in regular retail or online channels, he added.
