Putin simplified registration of rights to parking spaces in parking lots
Russian President Vladimir Putin has signed a law simplifying the procedure for the registration of parking spaces in parking lots which are in common shared ownership. The text of the document appeared on November 23 on the portal of official publication of legal acts.
This law was developed in accordance with the decision of the Constitutional Court of April 2023 and is aimed at protecting the rights of owners of parking spaces.
With the signing of this law, the owner of the car will be able to protect his right to a parking space in the parking lot. The owner of a share will be able to allocate his place in a separate real estate object, if any of the co-owners is against it or there are too many of them. Previously, this required the consent of each of the owners of the shares.
According to this law, the owner has the opportunity to engage a cadastral engineer to prepare a technical plan with clear boundaries of the allocated parking space. The engineer will also have to get access to the design documentation of the building and draw up a plan that will confirm the ownership share, publish a notice of allocation with the contact details of the owner, all information about himself, the scheme of the parking space itself and the deadline for filing objections.
If the other owners are not satisfied with the plan, it will be possible to file objections, which must be motivated. If there are no grounds, they will not be considered.
A parking space will be registered if there are no objections or if they can be challenged.
On October 11, the Russian Ministry of Transport submitted to the Russian government a "road map" to improve parking lots, which implies a wide introduction of paid parking lots in the regions with a simultaneous reduction of parking lots next to high-rise residential complexes of economy class. In particular, it is planned to reduce the number of parking lots near residential buildings in Russia by 2026.
According to the document, the Ministry of Construction, the Ministry of Internal Affairs and the Ministry of Transport of Russia by December 2025 will prepare adjustments to regulations for "flexible rationing of parking spaces" near residential complexes. The changes may come into force in 2026. To manage parking lots, it is planned to create a digital register of parking spaces, which will interact with other databases.
