Able-bodied but officially unemployed citizens who purchase expensive property have begun receiving requests from the Federal Tax Service (FTS) demanding to clarify the sources of funds. This was announced by RBC on July 30.
"The essence of the tax authority's requests is twofold. On the one hand, the tax indicates a lack of income that would allow for major acquisitions. On the other hand, it is assumed that if an individual has cars and real estate, especially if there are several apartments, then they are most likely rented out," said Dmitry Lomakin, CEO of Formula Consent law firm.
The experts added that similar requests are being received not only in Moscow, but also in other regions, including the Moscow Region, Perm Krai and Tatarstan. In some cases, the tax authorities invite the owners of several apartments to the commission, offering to submit declarations of 3-personal income tax or documents confirming the purpose of using the property.
According to experts, if the tax authority comes to the conclusion that a citizen has received undeclared income, he may receive additional personal income tax, penalties and a fine. At the same time, experts clarified that claims can be avoided if there are documents confirming the legitimate origin of funds, such as savings, income from the sale of property, inheritance, donation or loan.
"In all cases, it begins with the requirement to provide documents / explanations "outside the framework of tax audits." They came to individuals who have no official income at all according to personal income tax certificates," lawyer Ekaterina Boldinova is quoted as saying by Vesti.
On April 1, the Federal Tax Service announced that new rules for filling out payment orders for transfers to the budget system of the Russian Federation, such as taxes, fees and fines, as well as for payments to treasury accounts, came into force in Russia. Now individual entrepreneurs must indicate in the "Payer" field not only the surname, first name and patronymic, but also the status of the "sole proprietor" in parentheses.
On April 17, the agency clarified that those individuals who are highly likely to receive undeclared income will be subject to enhanced tax control on transfers. It was noted that transfers between close relatives will not be subject to control if they are not related to business activities.
