The Ministry of Finance of the Russian Federation has developed amendments to the CTP law, which provide for limiting the maximum amount of losses that can be recovered from an insurer in case of violation of its obligation to organize and pay for the repair of a damaged vehicle. The draft document was published on the government information portal on July 30.

Currently, the limit for compensation for property damage under CTP is 400 thousand rubles. However, if repairs are disrupted, motorists try to collect amounts from insurance companies in excess of this limit. In May, the Constitutional Court declared this practice illegal and indicated that the restriction should be more clearly fixed in the law.

As noted in the explanatory note to the draft law, the imposition of full property liability on the insurer, allowed by law enforcement practice, if he was unable to fulfill the obligation to organize the restoration of the vehicle within the insured amount, violates the balance of rights of participants in insurance legal relations.

The head of the All-Russian Union of Insurers, Evgeny Ufimtsev, told Izvestia that over-limit payments are more often received not by consumers, but by professional car lawyers who use gray areas in legislation and judicial practice, and for ordinary car owners this eventually leads to an increase in the cost of the policy. According to him, the law banning payments in excess of 400 thousand rubles for CTP should be adopted in 2026.
